1. Who these Terms are with, and accepting them

These Terms of Use ("Terms") are a legal agreement between you and MT AI Systems LTD, a company registered in England and Wales (company number 16910754, registered office 124 City Road, London EC1V 2NX, United Kingdom) ("we", "us"), for your use of the SnagCam: Site Evidence Camera iPhone application ("SnagCam", the "App").

By ticking "I have read and accept the Terms of Use and Privacy Policy" during setup, or by installing or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not install or use the App. If you are using SnagCam on behalf of an employer or client, you confirm you have the authority to accept these Terms on their behalf, and "you" includes that organisation.

2. What SnagCam is — and what it is not

SnagCam is a tool for capturing and organising photo and video evidence on your iPhone: it timestamps, geotags and numbers your captures, lets you add markup and notes, and lets you generate a PDF or Word (.docx) report from your records.

SnagCam is a record-keeping and reporting aid. It is not, and does not replace: - an approved logbook, statutory register, periodic inspection report, or other record that the law requires a competent or authorised person to complete and sign; - a building control record, building inspection report, or "golden thread" record under building safety legislation; - an insurance, surveying or expert report prepared by a qualified professional; - an official notification to a regulator or authority (for example, an accident report to the Health and Safety Executive under RIDDOR in the UK, or a workplace accident notification to the Social Security Institution (SGK) in Turkey); or - any other form, register or certificate that a specific law, regulation, contract or professional body requires to be produced through its own designated process.

Where any such record or notification is required, the responsibility to produce it — through the correct channel, by the correct person, in the correct form — remains entirely yours (or your employer's). SnagCam's reports are evidence you can use to support those processes; they do not substitute for them.

3. Time, location and file integrity — what we can and cannot promise

• Time. SnagCam records the date and time from your iPhone's own clock, together with its time zone. We do not verify this against an external time server. If your device's clock is wrong, the timestamp will be wrong.
• Location. SnagCam uses your iPhone's built-in location services to record GPS coordinates and a reported accuracy figure at the moment of capture. GPS accuracy varies with your device, the weather, and your surroundings (it is typically less reliable indoors or between tall buildings). SnagCam flags low-accuracy readings rather than hiding them, and lets you confirm a location manually when GPS is unavailable — but we cannot guarantee the accuracy of any location reading.
• File integrity. SnagCam generates a SHA-256 fingerprint for each original photo or video on your device. This lets you or a third party check, at a later date, whether the specific file has been altered since that fingerprint was taken. It is a technical integrity check only. It does not certify who took the photo, that the timestamp or location shown is correct, or that a court, tribunal, insurer or any other body will accept the record as proof of anything. Whether any record produced by SnagCam is accepted as evidence, and what weight it is given, is a matter for the body considering it, under the law that applies to that proceeding.

4. Your responsibilities

You are responsible for: - the accuracy and appropriateness of everything you record, label and report using SnagCam; - having the right to be on the site, property or vehicle you are photographing, and to photograph it; - other people's personal data that may appear in your photos or video (for example, faces, name badges, or vehicle number plates). If you capture such images, you decide how they are used and you are responsible for complying with data protection law that applies to you (such as the UK GDPR or Turkey's KVKK) for your own purposes. SnagCam's blur tool is provided to help you obscure such details on a shared copy; it is a tool, not a guarantee of anonymisation, and using it does not by itself make your use of the data lawful; - working safely — for example, not operating the camera while walking, driving, climbing, or in any situation where doing so would create a hazard to you or others; and - complying with all laws, regulations, site rules and contractual obligations that apply to your work, independently of anything SnagCam records or does not record.

5. Your data stays on your device

SnagCam does not require an account and does not send your photos, video, notes or location data to us or to any third party as part of using the App. Everything is stored locally on your iPhone.

This means: - we cannot see, recover, back up or restore your data — there is nothing on our servers to retrieve, because nothing is sent to a server; - if you delete the App, your SnagCam data is deleted with it — including reports and ZIP files kept in Files › On My iPhone › SnagCam — unless you have saved or sent a copy somewhere outside SnagCam (for example to iCloud Drive, by email or to a computer), or your iPhone is backed up; and - keeping copies of anything you need — by saving or sending a PDF, Word or ZIP file to a place outside SnagCam — is your responsibility.

6. Intellectual property and acceptable use

The App itself — its software, design, and branding — belongs to us or our licensors. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable licence to use the App on Apple-branded devices you own or control, for your own or your employer's lawful business purposes.

The content you create with SnagCam — your photos, video, notes and reports — belongs to you. Because that content never reaches our servers, we do not hold, and do not claim, any licence to it.

You must not use SnagCam: - for unlawful surveillance of any person; - to create or alter a record with the intention of misleading anyone about when, where, or by whom something was captured; - to forge, falsify or misrepresent evidence, or to impersonate another person or organisation in a report; or - in any way that infringes another person's rights or breaches applicable law.

7. The free version, and future paid features

At the date of this version, SnagCam is provided free of charge, with no in-app purchases or subscriptions. Reports, video and information bands generated in the free version carry SnagCam branding.

We may in future offer optional paid features (for example, a subscription that removes branding or adds capabilities). If we do, separate terms covering pricing, billing and cancellation will apply to those features, and you will be asked to agree to them before you subscribe. Nothing in this section obliges us to introduce paid features, or to keep the current free features free indefinitely, though we will give reasonable notice of any change that removes a feature you rely on.

8. Disclaimers and limitation of liability

The App is provided "as is" and "as available". To the fullest extent permitted by law, we exclude all warranties, conditions and representations not expressly set out in these Terms, including any warranty that the App will be uninterrupted, error-free, or fit for a particular purpose beyond what is described in Section 2.

To the fullest extent permitted by law, we are not liable to you for any indirect or consequential loss, or for any loss of profit, business, contracts, or anticipated savings, arising out of or in connection with your use of the App.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. Nothing in these Terms affects your statutory rights as a consumer, including any rights you have under the UK Consumer Rights Act 2015 or, where applicable, under the mandatory consumer protection law of the country in which you are habitually resident.

9. Apple — a note on the App Store

The App is made available to you through the Apple App Store, and this licence is between you and us only — not Apple. Apple has no obligation to provide maintenance or support for the App. Apple is not responsible for any product claims relating to the App (for example, claims about product liability, failure to conform to any applicable legal or regulatory requirement, or consumer protection or similar legislation), which are our responsibility to the extent set out in these Terms. In the event of any third-party claim that the App infringes a third party's intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you; to the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App. You must comply with applicable third-party terms of agreement when using the App (for example, your mobile network agreement). Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.

10. Changes, ending your use, law and contact

We may update these Terms from time to time — for example, when a new App version changes what SnagCam does, or when we introduce paid features. Where a change is material, the App will ask you to review and accept the new version before you can continue using it; the version number and date at the top of this document will change accordingly.

You may stop using SnagCam at any time by deleting the App. We may suspend or end your right to use the App if you materially breach these Terms, in particular Section 6 (Acceptable use).

These Terms are governed by the laws of England and Wales, without prejudice to any mandatory consumer protection law of the country in which you are habitually resident, which continues to apply to you where it would otherwise do so. Nothing in this section prevents a consumer from bringing proceedings in the courts of their own country of residence where the law gives them that right.

1. Taraflar ve kabul

Bu Kullanım Koşulları ("Koşullar"), İngiltere ve Galler'de kayıtlı MT AI Systems LTD (şirket numarası 16910754, kayıtlı ofis: 124 City Road, London EC1V 2NX, Birleşik Krallık) ("biz", "şirket") ile sizin aranızda, SnagCam: Site Evidence Camera iPhone uygulamasının ("SnagCam", "Uygulama") kullanımına ilişkin bir sözleşmedir.

Kurulum sırasında "Kullanım Koşulları'nı ve Gizlilik Politikası'nı okudum, kabul ediyorum" kutusunu işaretleyerek veya Uygulamayı kurup kullanarak bu Koşulları ve Gizlilik Politikamızı kabul etmiş olursunuz. Kabul etmiyorsanız Uygulamayı kurmayınız veya kullanmayınız. SnagCam'i bir işveren veya müşteri adına kullanıyorsanız, bu Koşulları onlar adına kabul etme yetkiniz olduğunu beyan etmiş olursunuz ve "siz" ifadesi o kurumu da kapsar.

2. SnagCam nedir — ve ne değildir

SnagCam, iPhone'unuzda fotoğraf ve video kanıtı toplamanıza ve düzenlemenize yarayan bir araçtır: çekimlerinizi zaman ve konum damgası ile numaralandırır, işaretleme ve not eklemenize izin verir, kayıtlarınızdan PDF veya Word (.docx) raporu oluşturmanızı sağlar.

SnagCam bir kayıt tutma ve raporlama yardımcısıdır. Aşağıdakilerin YERİNE GEÇMEZ: - yetkili veya uzman bir kişinin doldurup imzalamasını kanunun aradığı onaylı defter, resmî sicil/kayıt, periyodik kontrol raporu veya benzeri bir belge; - yapı denetim kaydı, yapı denetim tutanağı veya bina güvenliği mevzuatı kapsamındaki eşdeğer kayıtlar; - yetkili bir uzman tarafından hazırlanan sigorta, ekspertiz veya bilirkişi raporu; - bir düzenleyici kuruma veya resmî mercie yapılması gereken bildirim (örneğin Türkiye'de Sosyal Güvenlik Kurumu'na (SGK) yapılan iş kazası bildirimi veya Birleşik Krallık'ta RIDDOR kapsamında Health and Safety Executive'e yapılan kaza bildirimi); veya - belirli bir kanun, yönetmelik, sözleşme veya meslek kuruluşu tarafından kendi belirlediği usulle üretilmesi zorunlu tutulan başka herhangi bir form, sicil veya belge.

Böyle bir kayıt veya bildirimin gerektiği her durumda, bunu doğru kanaldan, doğru kişi tarafından, doğru biçimde üretme sorumluluğu tamamen size (veya işverenize) aittir. SnagCam raporları bu süreçleri desteklemek için kullanabileceğiniz kanıtlardır; onların yerine geçmez.

3. Zaman, konum ve dosya bütünlüğü — neyi garanti edebiliriz, neyi edemeyiz

• Zaman. SnagCam, tarih ve saati iPhone'unuzun kendi saatinden, saat dilimiyle birlikte kaydeder. Bunu dışarıdan bir zaman sunucusuyla doğrulamayız. Cihazınızın saati yanlışsa, zaman damgası da yanlış olur.
• Konum. SnagCam, çekim anında iPhone'unuzun konum servislerini kullanarak GPS koordinatlarını ve bildirilen bir doğruluk değerini kaydeder. GPS doğruluğu; cihazınıza, hava koşullarına ve bulunduğunuz ortama göre değişir (genellikle kapalı mekânlarda veya yüksek binalar arasında daha az güvenilirdir). SnagCam düşük doğruluklu okumaları gizlemek yerine açıkça belirtir ve GPS mevcut olmadığında konumu elle onaylamanıza imkân tanır — ancak herhangi bir konum okumasının doğruluğunu garanti edemeyiz.
• Dosya bütünlüğü. SnagCam, cihazınızda her orijinal fotoğraf veya video için bir SHA-256 parmak izi oluşturur. Bu, sizin veya üçüncü bir tarafın, o parmak izi alındıktan sonra ilgili dosyanın değiştirilip değiştirilmediğini daha sonra kontrol etmesini sağlar. Bu yalnızca teknik bir bütünlük kontrolüdür. 4. Sizin sorumluluklarınız

Aşağıdakilerden siz sorumlusunuz: - SnagCam ile kaydettiğiniz, etiketlediğiniz ve raporladığınız her şeyin doğruluğu ve uygunluğu; - fotoğrafladığınız saha, mülk veya araçta bulunma ve onu fotoğraflama hakkına sahip olmanız; - fotoğraf veya videolarınızda görünebilecek başka kişilerin kişisel verileri (örneğin yüzler, isim kartları veya araç plakaları). Bu tür görüntüleri çekerseniz, bunların nasıl kullanılacağına siz karar verirsiniz ve kendi amaçlarınız için geçerli veri koruma mevzuatına (örneğin Türkiye'de KVKK veya Birleşik Krallık'ta UK GDPR) uyum sizin sorumluluğunuzdadır. SnagCam'in bulanıklaştırma aracı, paylaştığınız kopyada bu tür detayları gizlemenize yardımcı olmak için sunulur; bir araçtır, anonimleştirme garantisi değildir ve kullanılması tek başına verinin işlenmesini hukuka uygun hâle getirmez; - güvenli çalışmak — örneğin yürürken, araç kullanırken, tırmanırken veya kendinize ya da başkalarına tehlike yaratacak herhangi bir durumda kamerayı çalıştırmamak; ve - SnagCam'in kaydedip kaydetmediğinden bağımsız olarak, işinize uygulanan tüm kanunlara, yönetmeliklere, saha kurallarına ve sözleşmesel yükümlülüklere uymak.

5. Verileriniz cihazınızda kalır

SnagCam hesap gerektirmez ve Uygulamayı kullanırken fotoğraflarınızı, videolarınızı, notlarınızı veya konum verilerinizi bize ya da üçüncü bir tarafa göndermez. Her şey iPhone'unuzda yerel olarak saklanır.

Bu Koşullara tabi olarak, size sahip olduğunuz veya kontrol ettiğiniz Apple markalı cihazlarda, kendi veya işvereninizin meşru iş amaçları için Uygulamayı kullanma hakkı tanıyan kişisel, münhasır olmayan, devredilemez bir lisans veriyoruz.

SnagCam ile oluşturduğunuz içerik — fotoğraflarınız, videolarınız, notlarınız ve raporlarınız — size aittir. Bu içerik sunucularımıza hiç ulaşmadığı için, üzerinde herhangi bir lisans hakkı iddia etmiyoruz.

SnagCam'i şu amaçlarla kullanamazsınız: - herhangi bir kişinin hukuka aykırı biçimde gözetlenmesi; - bir kaydın ne zaman, nerede veya kim tarafından oluşturulduğu konusunda birini yanıltma niyetiyle oluşturulması veya değiştirilmesi; - kanıt sahteciliği, tahrifatı veya yanlış beyanı, ya da bir raporda başka bir kişi veya kurum yerine geçilmesi; veya - başka bir kişinin haklarını ihlal eden veya yürürlükteki mevzuata aykırı herhangi bir şekilde kullanılması.

7. Ücretsiz sürüm ve ileride sunulabilecek ücretli özellikler

Bu sürümün tarihi itibarıyla SnagCam, uygulama içi satın alma veya abonelik olmaksızın ücretsiz olarak sunulmaktadır. Ücretsiz sürümde oluşturulan raporlar, videolar ve bilgi bantları SnagCam markasını taşır.

İleride isteğe bağlı ücretli özellikler (örneğin markayı kaldıran veya ek yetenekler ekleyen bir abonelik) sunabiliriz. Bunu yaparsak, bu özellikler için fiyatlandırma, faturalama ve iptali kapsayan ayrı şartlar geçerli olacak ve abone olmadan önce bunları kabul etmeniz istenecektir. Bu bölümdeki hiçbir ifade bizi ücretli özellik sunmaya veya mevcut ücretsiz özellikleri süresiz olarak ücretsiz tutmaya zorunlu kılmaz; ancak dayandığınız bir özelliği kaldıracak her değişiklik için makul bir bildirim süresi tanıyacağız.

8. Sorumluluk reddi ve sınırlaması

Uygulama "olduğu gibi" ve "mevcut olduğu şekliyle" sunulmaktadır. Yürürlükteki mevzuatın izin verdiği azami ölçüde, bu Koşullarda açıkça belirtilmeyen tüm garanti, koşul ve beyanları — Uygulamanın kesintisiz, hatasız veya 2. Bölümde tanımlananın ötesinde belirli bir amaca uygun olacağına dair herhangi bir garanti dahil — hariç tutarız.

Yürürlükteki mevzuatın izin verdiği azami ölçüde, Uygulamayı kullanımınızdan doğan veya bununla bağlantılı hiçbir dolaylı veya sonuç niteliğindeki zarardan, ya da kâr, iş, sözleşme veya öngörülen tasarruf kaybından sorumlu değiliz.

Bu Koşullardaki hiçbir hüküm, ihmalimizden kaynaklanan ölüm veya kişisel yaralanmaya, hile veya hileli yanlış beyana, ya da hukuken hariç tutulamayan veya sınırlandırılamayan başka herhangi bir sorumluluğa ilişkin sorumluluğumuzu hariç tutmaz veya sınırlamaz. Bu Koşullardaki hiçbir hüküm, Birleşik Krallık Consumer Rights Act 2015 kapsamındaki haklarınız da dahil olmak üzere bir tüketici olarak sahip olduğunuz yasal haklarınızı ya da uygulanabilir olduğu ölçüde mutad meskeninizin bulunduğu ülkenin emredici tüketici koruma mevzuatını etkilemez.

9. Apple — App Store hakkında bir not

Uygulama size Apple App Store üzerinden sunulmaktadır ve bu lisans yalnızca sizinle bizim aramızdadır — Apple ile değil. Apple'ın Uygulama için bakım veya destek sağlama yükümlülüğü yoktur. Apple, Uygulamaya ilişkin ürün iddialarından (örneğin ürün sorumluluğu, yürürlükteki bir yasal veya düzenleyici gerekliliğe uymama, tüketici koruma veya benzeri mevzuata ilişkin iddialar) sorumlu değildir; bunlar, bu Koşullarda belirtilen ölçüde bizim sorumluluğumuzdadır. Uygulamanın üçüncü bir tarafın fikri mülkiyet haklarını ihlal ettiğine dair bir iddia olması hâlinde, bu iddianın araştırılması, savunulması, uzlaşılması ve sonuçlandırılmasından Apple değil biz sorumluyuz. Uygulama geçerli bir garantiye uymazsa, Apple'a bildirebilirsiniz ve Apple, varsa Uygulama için ödediğiniz bedeli size iade edecektir; yürürlükteki mevzuatın izin verdiği azami ölçüde, Apple'ın Uygulamaya ilişkin başka hiçbir garanti yükümlülüğü yoktur. Uygulamayı kullanırken yürürlükteki üçüncü taraf sözleşme şartlarına (örneğin mobil operatör sözleşmeniz) uymanız gerekir. Apple ve Apple'ın bağlı şirketleri bu Koşulların üçüncü taraf lehtarlarıdır ve kabulünüz üzerine Apple, bu Koşulları üçüncü taraf lehtarı sıfatıyla size karşı uygulama hakkına sahiptir.

10. Değişiklikler, kullanımın sona ermesi, uygulanacak hukuk ve iletişim

Bu Koşulları zaman zaman güncelleyebiliriz — örneğin yeni bir Uygulama sürümü SnagCam'in ne yaptığını değiştirdiğinde veya ücretli özellikler sunduğumuzda. Bir değişiklik önemli olduğunda, Uygulama kullanmaya devam etmeden önce yeni sürümü incelemenizi ve kabul etmenizi isteyecektir; bu belgenin üstündeki sürüm numarası ve tarih buna göre değişecektir.

Uygulamayı silerek dilediğiniz zaman kullanmayı bırakabilirsiniz. Bu Koşulları, özellikle 6. Bölümü (Kabul edilebilir kullanım) esaslı biçimde ihlal etmeniz hâlinde Uygulamayı kullanma hakkınızı askıya alabilir veya sona erdirebiliriz.

Bu Koşullar, mutad meskeninizin bulunduğu ülkenin emredici tüketici koruma mevzuatı saklı kalmak kaydıyla, İngiltere ve Galler hukukuna tabidir; söz konusu mevzuat aksi hâlde uygulanacak olduğu ölçüde size uygulanmaya devam eder. Bu bölümdeki hiçbir hüküm, bir tüketicinin kanunun kendisine tanıdığı hâllerde kendi ikamet ülkesinin mahkemelerinde dava açmasını engellemez.
